The courthouse can be a confusing and intimidating place for a person bringing or defending a civil damages suit, says Plano attorney Richard Armstrong.
That is precisely why so many people avoid the courthouse, even when the evidence is on their side and their cause is just, suggests Armstrong. Fortunately, competent law firms using a variety of fee arrangements can remove the mystery and fear associated with the courtroom, as well as level the playing field. Just because a law firm is large doesn’t necessarily mean it will win.
According to Armstrong, much depends on the experience and commitment level of the attorneys representing the litigant. Some smaller firms beat larger firms in the courtroom as much because of their commitment to detail in preparation for trial as their actions during the trial itself. They know that, in order to win, they may have to work twice as hard as the other side, and then they roll up their sleeves and do whatever is necessary.
The final ingredient, says Armstrong is tenacity and perseverance. Many a trial or appeal has been lost because the losing party failed to go the distance against a smaller but more determined adversary. The easy argument doesn’t always prevail. If an important motion or trial produces an unfavorable outcome, always come back and re-argue it, perhaps with a fresh approach. A new judge or jury may see things differently. New facts may have been discovered which could alter the outcome.
